The owner of the website eventbook.ro is the company EVENTBOOK SRL, identified by CUI RO31145850, registered with the Trade Register under no. J2013000949406, with its registered office at Intr. Bădeni no. 3, sector 3, Bucharest, hereinafter referred to as “Eventbook”.
Eventbook is a ticketing platform which, based on contracts concluded with event organizers (“Organizers”), provides intermediation services for the sale of tickets and/or registration of participants at events.
The services may be provided through the eventbook.ro platform, through other web pages that use Eventbook solutions such as API or iframe, as well as offline, through the points of sale in the Eventbook network, the ticket offices of certain venues or the Organizers' points of sale.
Eventbook is not the Organizer of the events for which it sells tickets.
The Organizer is the entity responsible for organizing and conducting the event, establishing the schedule and access conditions, as well as for decisions regarding its cancellation, rescheduling or modification.
Eventbook provides ticketing services and intermediates the relationship between the buyer and the Organizer regarding the purchase of tickets and, where applicable, the processing of related requests, within the limits provided by these Terms and Conditions and applicable legislation.
By using the Eventbook platform and/or by purchasing a ticket, the buyer declares that they have read and accept these Terms and Conditions.
In these Terms and Conditions, the following terms shall have the meanings below:
Eventbook – EVENTBOOK SRL, the provider of ticketing services and operator of the eventbook.ro platform.
Organizer – the natural or legal person responsible for organizing and conducting the event for which Eventbook sells tickets.
Buyer – the person who purchases one or more tickets through Eventbook.
Ticket Holder / Participant – the person who uses the ticket for access to the event, regardless of whether this is or is not the person who made the purchase.
Ticket – the physical or electronic document issued through the Eventbook system which grants the right of access to the event under the conditions established by the Organizer.
Event – the show, concert, festival, screening, conference, competition or any other manifestation for which tickets are sold through Eventbook.
Order – the request submitted through the platform for the purchase of one or more tickets.
The ticket is valid for one person only and for a single access to the event inscribed on it, except where expressly stated otherwise, such as subscriptions with multiple entries or group tickets.
The ticket is valid exclusively for the event, date, time, category and, where applicable, seat inscribed on it.
The ticket holder has the obligation to verify the information inscribed on the ticket immediately after receiving it and to report any discrepancies to Eventbook.
Before completing an order, the buyer is presented with essential information regarding the event, the number and category of tickets, as well as the total price of the order.
The buyer is responsible for the accuracy of the data provided in the ordering process, including the email address used for sending the tickets.
The order is considered completed after payment confirmation, where online payment is required, and the issuance of the ticket or transmission of the order confirmation.
The mere initiation of a payment does not guarantee the reservation or issuance of the ticket if the payment is not confirmed.
In exceptional situations where payment has been made but ticket issuance could not be completed for technical reasons, the buyer will contact Eventbook to verify the transaction and resolve the situation.
The ticket price is the one displayed at the time of initiating the order.
Depending on the event, sales channel and payment or delivery method, ticketing fees, order processing fees, courier fees or other costs related to the services requested by the buyer may be added to the ticket price.
The total price to be paid is displayed to the buyer before completing the order.
Payment can be made through the methods made available by Eventbook for the respective event.
Eventbook is not responsible for the refusal or impossibility of processing a payment by the issuing bank, payment processor or other payment service providers, except in situations directly attributable to it.
Purchased tickets are refundable exclusively in case of event cancellation or rescheduling, under the conditions provided in point 6 below and in compliance with applicable legislation.
The Organizer is responsible for the decision to cancel or reschedule the event and has the obligation to communicate to Eventbook, in due time, all necessary information regarding this decision.
Eventbook, as an intermediary for ticket sales, will communicate to buyers the information received from the Organizer and will facilitate, where applicable, the processing of refund requests, under the conditions provided by these Terms and Conditions.
In the case of tickets purchased on physical support, the refund may be conditional upon the presentation of tickets in intact condition, if this is necessary for their identification and validation.
Purchased tickets are non-refundable, except in situations where the event for which they were purchased is cancelled or rescheduled, as well as in situations where the refund is imposed by mandatory legal provisions.
Outside these situations, the ticket value is not refunded, including in cases where the buyer or ticket holder can no longer or no longer wishes to attend the event.
In case of event cancellation or rescheduling, refund requests must be submitted to Eventbook within 28 days from the date of communication of the event cancellation or rescheduling. This deadline applies to the extent that it does not contravene applicable mandatory legal provisions.
Eventbook processes refunds within the limit of amounts from the sale of tickets for the event that are in its possession or that are made available to it by the Organizer for this purpose.
In the situation where the amounts collected from ticket sales have not yet been transferred to the Organizer, Eventbook will make the refund to buyers from those amounts.
In the situation where the amounts collected from ticket sales have already been transferred, in whole or in part, to the Organizer, the financial responsibility for refunding to buyers the amounts thus transferred belongs to the Organizer.
In this situation, Eventbook may facilitate communication with buyers and/or the technical processing of refunds, but the actual execution of the refund is conditional upon the return or making available to Eventbook, by the Organizer, of the necessary amounts.
Eventbook has no obligation to finance from its own funds the refund of amounts from ticket sales that have already been transferred to the Organizer and that have not been returned or made available to Eventbook by the Organizer, except in cases where such an obligation expressly results from applicable legislation.
Only the ticket fees will be refunded, as inscribed on the purchased tickets. Additional costs borne by the ticket holder for event participation will not be refunded, including ticketing fees, order processing fees, courier fees, bank commissions, accommodation expenses, plane or train tickets and other similar expenses, to the extent permitted by applicable legislation.
The event Organizer is responsible for the proper conduct of the event at the place and time mentioned on the ticket.
For tickets related to events that are to take place on a specific date or during a specific period, the general 14-day right of withdrawal for distance contracts does not apply, under the conditions provided by applicable legislation for services related to leisure activities.
Therefore, the buyer cannot request a refund of a ticket solely on the grounds that they have changed their mind, no longer wish to or can no longer attend the event.
The provisions of this point do not affect the rights that the consumer benefits from mandatorily according to law.
The Organizer may make, when circumstances require, changes regarding the schedule, order of appearance of artists or participants, access time, cast, line-up, activity schedule or other elements of the event.
Such changes do not automatically represent a cancellation or rescheduling of the event and do not automatically confer the right to ticket refund, except where the change is of such a nature that, according to applicable legislation, the buyer acquires such a right.
In case the event is moved to another date, it will be considered rescheduled within the meaning of points 5 and 6.
Access to the event is based on a valid ticket and in compliance with the rules established by the Organizer and/or the venue where the event takes place.
Depending on the nature of the event, the Organizer may establish special access conditions, including age limits, the obligation to present an identity document, rules regarding minor access, permitted or prohibited items and other safety measures.
The buyer and ticket holder have the obligation to consult the specific event information before participation.
The Organizer may refuse access or may request the departure from the event of persons who do not comply with access and conduct rules, disrupt the event or endanger the safety of other participants, under the conditions of law.
In such situations, if the measure is determined by the participant's behavior, they do not benefit from ticket refund.
The buyer is responsible for safely keeping the ticket and the QR code, barcode or any other element used for access validation.
The ticket must not be published, transmitted or made available to unauthorized persons.
In case there are multiple copies of the same ticket, access may be granted exclusively to the first person who presents and validates the ticket, if the access system operates on the basis of a single validation.
Eventbook cannot guarantee access to persons who have purchased tickets from unauthorized sources or from third parties and is not liable for counterfeit, duplicate, cancelled or fraudulently obtained tickets, to the extent that the situation is not attributable to it.
The ticket cannot be resold at a price higher than the value inscribed on it.
Eventbook does not guarantee the validity of tickets purchased from third parties or through unauthorized resale platforms or channels.
In the case of events for which tickets are nominal or subject to special transfer conditions, the buyer and ticket holder must comply with the specific conditions communicated for that event.
Tickets obtained through fraud, through unauthorized use of payment methods or through other illegal methods may be cancelled, in compliance with applicable legislation.
Non-attendance at the event for reasons not attributable to the Organizer or Eventbook does not grant the ticket holder the right to refund of its value or to use the ticket for another performance.
The ticket is valid only for the date and time inscribed on it.
In the case of certain events, access after the start time may be limited or permitted only at certain moments, depending on the rules established by the Organizer.
The conduct of an event may be affected by situations independent of the will of Eventbook or the Organizer, such as extreme weather conditions, authorities' provisions, security incidents, major utility interruptions, emergency situations or other unforeseeable or unavoidable events.
In such situations, the Organizer will decide, depending on circumstances and in compliance with applicable legislation, whether the event can continue, must be interrupted, rescheduled or cancelled.
In case of cancellation or rescheduling, the provisions of points 5 and 6 will apply.
No provision of this point limits the mandatory rights conferred to consumers by law.
The ticket holder is responsible for their personal belongings throughout the duration of the event.
Eventbook is not responsible for the loss, theft or damage of personal belongings occurring within the event venue, except in situations where the damage is directly attributable to it according to law.
For such situations, the participant must address the Organizer and/or representatives of the venue where the event takes place.
During events, photographs, filming and/or other audio-video recordings may be made by the Organizer, partners or persons authorized by them.
The processing and use of these materials is carried out by the entities responsible for their creation, in compliance with applicable legislation regarding the protection of personal data and the right to image.
Eventbook is not responsible for photographs or recordings made independently by the Organizer, their partners, venue representatives, accredited press or other participants, to the extent that Eventbook does not determine the purposes and means of that processing.
When Eventbook creates or uses such materials for its own purposes, data processing will be carried out in accordance with the Eventbook Privacy Policy and applicable legislation.
Eventbook processes personal data for the purpose of providing ticketing services, processing orders, communicating with users and fulfilling legal obligations.
Detailed information regarding the categories of data processed, the purposes and grounds for processing, storage periods and the rights of data subjects are provided in the Eventbook Privacy Policy, available on the website.
In certain situations, the data necessary for managing event participation may be transmitted to the Organizer, under the conditions and for the purposes provided by applicable legislation and the Privacy Policy.
Eventbook makes reasonable efforts to ensure the operation of the platform and ticketing services under appropriate conditions.
However, there may be temporary unavailability situations determined by maintenance, technical problems, interruptions of third-party provider services, communication problems or other circumstances independent of Eventbook.
Eventbook is liable for damages directly attributable to it, within the limits and conditions provided by applicable legislation.
Eventbook cannot be held responsible for the non-fulfillment of obligations that belong exclusively to the Organizer, event venue or other third parties, except in situations where applicable legislation establishes otherwise.
No provision in these Terms and Conditions shall be interpreted as excluding or limiting rights or forms of liability that cannot be excluded or limited by agreement of the parties according to law.
For issues regarding the purchase, issuance, transmission or technical processing of tickets, buyers may contact Eventbook at the contact details displayed on the website.
For quick resolution of a request, the buyer must provide, as applicable, the order number, email address used for purchase, event name and a description of the situation encountered.
Requests regarding the actual organization of the event, schedule, access conditions, artist performance or other aspects that belong exclusively to the Organizer may be transmitted to them or redirected to the Organizer, as applicable.
Eventbook seeks to resolve any misunderstandings with buyers amicably.
Consumers may use, under the conditions provided by applicable legislation, the Alternative Dispute Resolution (ADR) mechanisms made available through the National Authority for Consumer Protection.
Information and methods for accessing ADR procedures are available through ANPC.
These Terms and Conditions are governed by Romanian law.
Any misunderstandings will be resolved primarily amicably.
In case amicable resolution is not possible, disputes will be resolved by the competent courts according to applicable legislation, without affecting the special rights that consumers benefit from.
Eventbook may update these Terms and Conditions to reflect legislative changes, changes to the services provided or other objective reasons that justify their update.
The version applicable to an order is, as a rule, the version of the Terms and Conditions available and accepted at the time of placing the order, except in situations where the application of subsequent legal provisions is mandatory.
Eventbook recommends that users periodically consult the updated version of the Terms and Conditions available on the website.
In case one or more provisions of these Terms and Conditions are declared null, invalid or unenforceable, the other provisions will continue to have effect to the extent permitted by law.
Eventbook's failure to exercise a right provided in these Terms and Conditions does not constitute a waiver of that right.
These Terms and Conditions must be interpreted together with the Privacy Policy, Cookie Policy and specific information displayed for each event.
In case of a conflict between a provision of these Terms and Conditions and a mandatory legal provision, the applicable legal provision will prevail.
